Rape
Criminal Defense Lawyers For Rape In Indianapolis
Rape is an extremely complex and often difficult crime to defend. Often there is no physical evidence so allegations are contingent upon the testimony of the victim. In many rape allegation cases, the victim’s memory was impaired by the use of drugs and/or alcohol. The uncertainty that is caused by intoxication leads to the victim feeling violated and guilty. Many accusations stem from the victim’s shame and guilt.

What Indiana Law Says
In Indiana, rape can be committed several different ways. According to Indiana Code 35-42-4-1, rape is knowingly or intentionally having sexual intercourse with another person or knowingly or intentionally causing another person to perform or submit to other sexual conduct when:
- The other person is compelled by force or imminent threat of force
- The other person is unaware that the sexual intercourse or other sexual conduct is occurring
- The other person is so mentally disabled or deficient that consent to sexual intercourse or other sexual conduct cannot be given
Criminal penalties for rape allegations vary based on the violence, threat of force, weapons used, other aggravating factors and the age of the victim. Aggravating factors increase penalties because of the serious and malicious nature involved.
Indiana’s age of consent is 16 years old. Indiana also has a Romeo and Juliet Law that permits 14 and 15 year olds to engage in nonforced sexual activity with peers who are no more than 4 years older.
Rape Accusations Can Destroy Your Future
The basis of all rape cases always comes down to consent. Did the person being accused give consent? Did the victim give consent and then later regret it? Was the victim in a good mental state so that he or she could give consent? There are many favors that must be determined before a conviction is made. If the prosecution can convince a jury that consent was never given, then a conviction is almost guaranteed.
If you have been accused of rape in Indianapolis, do not wait to hire an experienced attorney who can provide a clear situation when facts are often foggy and unclear. You need to act fast so that you are not forever branded as a rapist and have your reputation crushed.
